How is the BACB's 2022 Ethics Code changing day-to-day supervision?

Section 4 consolidates supervisee protections that the 2014 compliance code left scattered, including an explicit prohibition on sexual contact with supervisees, mandatory documented feedback, and a duty to report supervisee incompetence. Why are session notes the number-one audit failure point in ABA?

Notes lacking specificity, missing signatures, or mismatched to billed CPT codes are now triggering pre-payment review and clawback exposure. What does "assent-based ABA" actually require operationally?

Under BACB Code Section 2.11, behavior analysts must obtain assent from clients "when applicable" — meaning continuous, individually defined behavioral indicators of willingness, not a one-time consent form. That obligates clinics to operationally define assent and withdrawal per client, retrain RBTs to read refusal as communication, and rebuild documentation to capture the data.
